  4. COMMUNITY PROPERTY LIST:

  7. "Community property" systems provide that whatever is accumulated
  8. during a marriage subject to that system is evenly divided among
  9. the spouses. The original justification for this is hazy, but,
  10. in the past Courts have noted that this allows a spouse who is 
  11. not working, but nevertheless contributing to the marriage by
  12. staying home gets a "fair share." Most but not all community
  13. property states also have a rule that property received by gift
  14. or inheritance is not community property, but, property of the
  15. spouse receiving the gift or legacy. In a few states community
  16. rights can be waived by special proceedings as to certain 
  17. property. Please seek counsel for more details.

  19. ALASKA - does not apply as to Alaska property; but, if spouses 
  20. lived in community property state then this is divided equally at 
  21. death.

  44. HAWAII - Does not apply (repealed in 1955); however, at death if 
  45. parties lived in community property state that property will be 
  46. so divided.

  48. IDAHO - Community property applies; however, as to real estate, 
  49. in certain circumstances deeds can provide that the property will 
  50. be individually held.

  52. ILLINOIS - Does not apply.
